Mediation is a voluntary, confidential process in which a neutral third party works with litigants to identify points on which they may reach agreement.
While a court may order parties to participate in mediation, the mediator has no power to require the parties to settle or to settle on specified terms. Mediation may occur at any stage from pre-litigation until the eve of trial. The process provides greater opportunity for client participation than does most of the litigation process, which contributes to its high success rate. Mediation also allows the parties to craft remedies and agreement features that a court is not authorized to order.

Early Neutral Evaluation (ENE) is a non-binding process in which litigants present a neutral evaluator with experience in the subject matter of the lawsuit with confidential, condensed case presentations through briefing, oral presentations, or both.
Unlike mediation, a primary purpose of ENE is to provide an informed opinion on how the trier of fact might decide one or more issues. With this information, litigants can evaluate the strengths and weaknesses of their respective cases.
The confidential evaluation is not revealed to the court and may be used to facilitate settlement or to narrow the issues for discovery or trial. The ENE process is explicitly authorized by both Wisconsin statute and the local rules for the Eastern District of Wisconsin.
